Acceptance of Terms​

By downloading, installing, or using PracticalKit ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

Description of Service​

PracticalKit is a desktop application that provides AI-powered file management and content generation capabilities. The Software connects to third-party AI services (such as OpenAI) using API keys you provide.

"As Is" Disclaimer​

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

IN NO EVENT SHALL THE AUTHORS, COPYRIGHT HOLDERS, OR CONTRIBUTORS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

Your Responsibilities​

  1. API Keys: You are responsible for obtaining and managing your own API keys for third-party services. Any costs incurred through these services are your responsibility.

  2. Data: You are responsible for your files and data. We recommend maintaining backups of important files.

  3. Compliance: You agree to use the Software in compliance with all applicable laws and regulations.

  4. Acceptable Use: You agree not to use the Software to:

    • Generate illegal, harmful, or abusive content
    • Violate the terms of service of connected third-party APIs
    • Infringe on the rights of others

Limitation of Liability​

To the maximum extent permitted by law, we shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Any damages resulting from your use or inability to use the Software
  • Any damages resulting from unauthorized access to or alteration of your files
  • Any damages resulting from third-party services or APIs

Alpha Software Notice​

PracticalKit is currently in alpha. This means:

  • The Software may contain bugs or errors
  • Features may change or be removed without notice
  • Data formats may change between versions
  • The Software may not be suitable for production or critical use cases

Changes to Terms​

We reserve the right to modify these terms at any time. Continued use of the Software after changes constitutes acceptance of the new terms.

Termination​

We reserve the right to terminate or suspend access to the Software at any time, without prior notice, for any reason.

Governing Law​

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
